5. Intellectual Property

All right, title, and interest in and to our services, including our website content, brand logo, software code, graphic designs, text, database structures, and trade secrets, are and will remain the exclusive property of SCube Solutions and its licensors. Our intellectual property is protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without our prior written consent.

6. AI Content & Outputs Disclaimer

Disclaimer on AI-Generated Outputs: Certain software products, custom code generation tools, or automated services developed by SCube Solutions leverage advanced artificial intelligence algorithms. AI systems produce probabilistic results. We do NOT guarantee the absolute accuracy, reliability, security, completeness, or fit-for-purpose nature of AI-generated code, text, files, or automations.

You acknowledge and agree that:

  • All AI-generated results, suggestions, code blocks, or automated analyses must be reviewed, tested, and validated by qualified human professionals prior to deployment in production environments.
  • SCube Solutions shall not be held liable for any system crashes, security vulnerabilities, business disruptions, or financial losses resulting from the use of unchecked AI-generated outputs.

7. Payments & Subscriptions

For SaaS subscriptions or custom consulting projects, the following payment terms apply:

  • Subscription Fees: SaaS services are billed on a recurring subscription basis (monthly or annually). Payments are processed securely via approved payment gateways.
  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date through your dashboard or by emailing support@scube.solutions.
  • Taxes: All fees are exclusive of applicable taxes, which will be calculated and added to invoice totals where required by law.
  • Refund Policy: Except as explicitly required by local consumer laws, all subscription fees, consulting deposits, and software deployment charges are non-refundable. Refund requests are evaluated solely on a case-by-case basis at our absolute discretion.

8. Software Licensing

When you purchase or subscribe to SaaS products developed by SCube Solutions, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the software in accordance with these Terms and any specific End-User License Agreement (EULA) provided at purchase. You acquire no ownership rights in our software.

9. Service Availability

We strive to achieve high availability for our SaaS products and websites. However, we do not warrant that our services will be uninterrupted, error-free, or completely secure. We may periodically perform scheduled maintenance, upgrades, or emergency fixes, which may cause temporary downtime. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without liability.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SCube Solutions, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data loss, loss of goodwill, system downtime, or other intangible losses, arising out of or relating to:

  • Your access to or use of (or inability to access or use) our website or software.
  • Any conduct or content of any third party on the services.
  • Any outputs, suggestions, or automation scripts generated by our AI tools.

Our total cumulative liability for any claim arising under these Terms shall not exceed the amount paid by you to us for the specific service giving rise to the claim during the six (6) months prior to the incident.

11. Indemnification

You agree to defend, indemnify, and hold harmless SCube Solutions and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your infringement of any intellectual property or privacy rights of third parties.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the competent courts located in Hyderabad, Telangana, India, and you consent to the personal jurisdiction of such courts.
